Tobacco Products Control Bill

The Tobacco Products Control Bill 2005 (the Bill) is currently before the Parliament. The Bill will replace the current Tobacco Control Act 1990 and proposes to ban tobacco advertising and other forms of promotion, requires all persons who sell tobacco products to be licensed and proposes substantial fines for those who sell or supply tobacco products to minors. Improved enforcement and investigation provisions to support compliance activities are also proposed, which will see Western Australia with some of the toughest tobacco laws in Australia.

Smoking in Enclosed Public Places

The Bill will also become the head of power for regulations dealing with smoking in enclosed public places.  Environmental Health Officers (EHO’s) will still have a role in the monitoring and enforcement of the regulations.

From 31 July 2006, smoking was banned in all enclosed public places including those within all licensed premises, except the Burswood Casino’s International Room.
This means that Western Australia was one of the first Australian States and Territories to have total smoking bans in all enclosed public places, including hospitality venues.
