What Is Local Planning Scheme No. 4
A Local Planning Scheme (previously referred to as a Town Planning Scheme) is a legal document that sets out how land can be used and what controls relate to development, use and subdivision of land.
The Shire’s current Local Planning Scheme is Town Planning Scheme No. 3, which came into operation on 18 March 1994.
The Shire has prepared draft Scheme No. 4 as required by the then Minister for Planning and Infrastructure.
Scheme No. 4 is comprised of the Scheme Text and Scheme Maps. The Scheme Maps include both maps showing Zones and Reserves, and maps showing Special Control Areas. Scheme No. 4 should be read in conjunction with the Strategy and vice versa. Decisions made under Scheme No. 4 are required to be consistent with the Strategy.
Purposes of Scheme No.4
Scheme No. 4 has the following purposes:
Sets out the planning aims and intentions for the Shire of Mundaring as a whole
Sets aside land as reserves for public purposes
Zones land within the Scheme area for the purposes defined in the Scheme
Controls and guides land use and development
Sets out procedures for the assessment and determination of planning applications
Makes provisions for the administration and enforcement of the Scheme; and
Addresses other matters set out in Schedule 7 of the Planning and Development Act 2005.
Aims of Scheme No.4
Scheme No. 4 has several aims. The main aim is for environmental, economic and social sustainability through a land use planning framework that balances the benefits and impacts of development on the Shire’s natural, built, social and economic environment. Most of the other aims of the Scheme flow from this central aim.
In terms of environmental sustainability, Scheme No. 4 aims to preserve the Shire’s biodiversity and environmental values through appropriate protection of areas of significant native vegetation, valuable habitat areas and other areas of environmental value. The Scheme also aims to assist in effective management of water sources, rivers and other water bodies and to promote a more energy-efficient form of development.
In terms of social and economic sustainability, Scheme No. 4 aims to provide an adequate supply of land for housing, employment and commercial activities to promote the development of the Mundaring Town Centre and local centres, provide variety and choice in housing to meet changing community needs (in particular housing for aged or dependent persons) and to protect and facilitate agricultural activity.
