Off Road Vehicle Use in the Shire of Mundaring

 

The use of any Off Road Vehicle in any public area within the Shire is unauthorised.

 

In accordance with the provisions of the Control of Off Road Vehicles Act, the following statutes are enforced by the Shire of Mundaring Council Western Australia Police Services, Water Corporation and the Department of CALM.

 

Section 6 (1&2) Driving and Using Off-Road Vehicles

(1)     A person shall not drive or use an off-road vehicles in any area to which this section applies other than:

          (a)      on private land by consent; or

          (b)     on land comprised within a permitted area, unless permitted to do so pursuant to section *(4) or deemed to have been permitted to do so pursuant to subsection (5) of that section.

Penalty:  $500

 Section 7 Failure to Register a Vehicle, Driving an Unregistered Vehicle of Failing to Carry a Registration Certificate on the Vehicle.

(1)    Failure to Register a Vehicle is required by the Act

(2)     Drive or use, permit to be driven or used, a Vehicle required to be registered under this Act.

(3)     All Vehicles used or driven within the area of the State requires to be registered with the Registration Certificate to be displayed on the Vehicle.

Penalty:  $200 for each offence

 Section 42  A Vehicle may be detained

If it used in the commission of an offence in relation to the Act or where the vehicle is so constructed or in a condition of where it is used or likely to occasion danger to any person or property.

Penalty:  The Vehicle may be detained for a period not exceeding 12 months with costs being recovered

 General

It is an offence to display incorrect or false Registration Plates, obscure or deface Registration Plates, not display Registration Plates, create excessive noise, not wear an approved helmet, fail to provide name and address, provide a false or incorrect name and address.

Penalty:  Up to $500 for each offence
