What is the purpose of the community consultation?

Shire of Mundaring is undertaking a review of its local laws in accordance with section 3.16 of the Local Government Act 1995:

  • Activities on Thoroughfares and Trading in Thoroughfares and Public Places Local Law 2004
  • Bush Fire Brigades Local Law 2013
  • Cemeteries Local Law 2014
  • Dogs Local Law 2017
  • Extractive Industries Local Law 2014

  • Local Government Property Local Law 2014
  • Meeting Procedures Local Law 2015
  • Parking Local Law 2009
  • Signs Local Law 2010.

As part of the review the Shire is seeking community feedback on each local law to help identify whether any of these require amendment or repeal.

Why is the Shire reviewing its local laws?

Section 3.16 of the Local Government Act 1995 requires a local government to undertake a review of its local laws within a period of eight years from the day on which the local law commenced or was amended.

The Shire's local laws were last reviewed in 2013/14 and therefore this review is due within the 2021/22 financial year.

What is the role of community consultation in the review?

The Shire is required to undertake community consultation as part of the local laws review. This is to gauge public opinion on the contents and ongoing suitability of the local laws.

Following the review process, where it is identified that a local law is to be amended or repealed, the Shire is required to undertake further community consultation for each local law that is affected.

Who is being consulted on this review?

The Shire is inviting submissions from all community members interested in the local laws review.

What happens next?

The Shire will consider all submissions received and prepare a report for Council on the outcomes of the consultation. These outcomes, together with recommendations from Shire staff, will be used to determine whether any changes to local laws are required.

Should any changes be required, the Shire will commence a separate local law process that will involve further community consultation.

How do I provide feedback?

Submissions can be made in writing via email to: shire@mundaring.wa.gov.au or through the Engage Mundaring portal Shire of Mundaring | Review of Local Laws.

All submissions must include your full contact details.
