Shire of Mundaring has been advised that Satterley Property Group Pty Ltd has lodged an application with the Supreme Court of Western Australia for leave to appeal the State Administrative Tribunal's 23 September 2026 decision to refuse the proposed North Stoneville Structure Plan.
The grounds of appeal are not yet known and are expected to be provided, along with other detailed material, in approximately 35 days. Any appeal is confined to questions of law.
The Western Australian Planning Commission (WAPC) is the first respondent to the appeal and will have primary responsibility for seeking to uphold the Tribunal's decision.
Shire President Paige McNeil said the Shire understood the strong community concern about North Stoneville and would continue to keep residents informed as the matter progresses.
“North Stoneville has been a significant planning issue for our community for many years, and we know residents will want to understand what this latest development means.
“The Shire will closely follow the process and work with the Western Australian Planning Commission to uphold the decision.
"We will continue to keep our community informed as further information becomes available.”
On behalf of Council, President Paige McNeil has written to Planning Minister John Carey regarding Council's position to rezone the land to allow for rural residential development and is awaiting a response.
